Terms of Service

These Terms of Service ("Terms") govern your use of the Bhasma mobile application ("the app") and the bhasma.io website ("the website"), collectively referred to as "the Service". By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. The Service

Bhasma is a free, offline-first mobile application that allows you to write text, read it once, and permanently destroy it. The app is intended as a mindfulness and emotional-release tool. It is not a notes app, a journal, a messaging service, or a backup system.

2. Eligibility

You must be at least 13 years old, or the minimum age of digital consent in your jurisdiction, to use Bhasma. By using the Service, you represent that you meet this requirement. The app is suitable for users of all ages and contains no mature content, advertising, or social features.

3. License to use the app

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Bhasma app on devices you own or control, solely for your personal, non-commercial use. This license is subject to these Terms and to the applicable terms of the Apple App Store or Google Play Store from which you downloaded the app.

4. What you may not do

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the app, except to the extent such activity is expressly permitted by applicable law
• Modify, adapt, or create derivative works of the app
• Remove, obscure, or alter any copyright, trademark, or other proprietary notices
• Use the app for any illegal purpose, or in any way that violates any applicable law
• Use the app to threaten, defame, or harass any person
• Attempt to probe, scan, or test the vulnerability of the app or the website, or breach any security or authentication measures
• Use any automated system (robot, scraper, etc.) to access or interact with the Service
• Redistribute the app outside the official app stores

5. User-generated content

Text you write in Bhasma is your content. You retain all rights, title, and interest in it. Because the app does not store, transmit, or share what you write, we never have access to your content, never possess a copy of it, and never acquire any rights to it. Your content exists only in the transient memory of your device and is permanently destroyed when the app closes or when you choose to burn it.

You are solely responsible for any content you write. You acknowledge that the destruction of content through the "burn" feature is irreversible and no recovery is possible by us or by any third party.

6. Fees and pricing

Bhasma is provided free of charge. The app contains no in-app purchases, no subscriptions, no advertising, and no premium tiers. This is a deliberate product decision and is part of the app's philosophy. We reserve the right to change pricing in the future, but any such change will be announced in advance and will not retroactively affect the free version you already installed.

7. Privacy

Your privacy is central to Bhasma. Please read our Privacy Policy to understand how we handle (or, more accurately, do not handle) your information. The Privacy Policy is incorporated into these Terms by reference.

8. Third-party services

The app is distributed through the Apple App Store and the Google Play Store, and your use of those platforms is subject to their respective terms and policies. We are not responsible for the actions, content, or policies of Apple, Google, or any other third party.

The website's contact form uses a third-party form-submission service (Web3Forms) to route feedback to us. Submission of feedback is optional and is governed by our Privacy Policy.

9. Intellectual property

The name "Bhasma", the logo, the app icon, the website design, the in-app typography choices, and all original code, audio, and copy are the intellectual property of the Bhasma creator, protected by copyright and trademark law. The Cormorant Garamond and JetBrains Mono typefaces are used under the SIL Open Font License. The singing-bowl audio is used under the Creative Commons Attribution 4.0 license from Orange Free Sounds.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the app will be uninterrupted, error-free, or free from harmful components, nor that any particular content will be available, preserved, or recoverable.

Bhasma is a mindfulness tool and is not a substitute for professional mental health care, medical advice, therapy, or crisis intervention. If you are in distress, please contact a qualified mental health professional or a crisis helpline in your region.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF TEXT, LOSS OF SATISFACTION, EMOTIONAL DISTRESS, OR ANY OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

In particular, because the app intentionally and permanently destroys text you write, we are not liable for any loss of content — that is the core promise of the Service. You use the app with the understanding that anything you write may be and will be destroyed without the possibility of recovery.

12. Indemnification

You agree to indemnify, defend, and hold harmless the Bhasma creator from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of another party.

13. Apple App Store and Google Play — Additional Terms

If you downloaded the app from the Apple App Store, you acknowledge that these Terms are between you and the Bhasma creator, and not with Apple. Apple is not responsible for the app, its content, or any claims related to it. Apple is a third-party beneficiary of these Terms and may enforce them against you as a user.

If you downloaded the app from the Google Play Store, these Terms govern in addition to the Google Play Terms of Service. Google is not a party to these Terms.

14. Termination

These Terms remain in effect as long as you use the Service. You may terminate these Terms at any time by uninstalling the app and ceasing to use the website. We may terminate or restrict your access to the Service at any time if you violate these Terms. Upon termination, your license to use the app ends, but any provisions that by their nature should survive (including disclaimers, limitations of liability, and intellectual property rights) will remain in effect.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will also note the change in the app's update notes on the stores. Your continued use of the Service after any update constitutes acceptance of the revised Terms.

16. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-laws principles. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in India, except that users in other jurisdictions retain any non-waivable rights available to them under local consumer-protection laws.

17. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
